Payment of employees: public holiday falling on a Sunday

24 September 2023 is a public holiday in South Africa.

As this date falls on a Sunday this year, in terms of the Public Holiday Act, the following Monday is also a public holiday.

The question that arises is how employees should be paid for these days. There are two scenarios:

  • Where employees do not normally work on a Sunday but on a Monday, no payment for Sunday is required.
If the employees do not work on the Monday, they should be paid the normal pay they would have received for working on a Monday. However, if the employees work on the public holiday Monday, they are entitled to at least double the amount they would have normally received for working on a Monday.
  • Where employees normally work on a Sunday and a Monday.
If the employees do not work on the Sunday or the Monday, they should be paid the normal pay they would have received for working on those days. However, if the employees work on the Sunday and/or Monday, they are entitled to at least double the amount they would have normally received for working on those days.
