Employment Equity: new draft regulations on proposed sectoral targets

Yesterday, on 1 February 2024, the Minister of Employment and Labour published the new Draft Regulations on Proposed Sectoral Numerical Targets in the Government Gazette for public comment.

NEASA has always and will always, in principle, oppose the notion of allowing race to dictate and limit the freedom of any employer or business to appoint whomever it chooses. Appointment and employment on merit is the only surefire way a business can ensure efficiency and success.
In addition to NEASA’s opposition to the core principle of sectoral targets based on race and the infringement on the rights of employers, the new draft regulations are contentious on several technical grounds.

NEASA is in the process of drafting its written submissions on these newly published regulations and will, if necessitated, take legal action to review the regulations should they be promulgated.
