2021 Employment Equity: When to deregister

Between 1 September 2021 and 15 January 2022, all designated employers must submit their annual Employment Equity reports to the Department of Employment and Labour.

However, employers who have fallen below the industry threshold (to view click here), as set out in the Employment Equity Act (EEA), can apply to deregister from the Employment Equity (EE) register and, if successful, will consequently not be required to submit reports, provided that they remain below the threshold.

An employer falls below the threshold when it employs less than 50 employees and has a total annual turnover below the relevant industry threshold in terms of Schedule 4 of the EEA.

Companies may deregister during the months of July and August each year, before the online submissions system opens on 1 September.
